General terms and conditions

Hirschegg Ski School

The following business terms are applicable to all services and contracts, which you conclude with Skischule Hirschegg GmbH (hereinafter „Ski School Hirschegg“)


1. Basic provisions

Unless otherwise agreed upon these terms and conditions apply to all legal relationships between Ski School Hirschegg and any person making use of the services offered by it (hereinafter: “Customer”). They also apply to all contracts, which a customer concludes via the www.skischule-hirschegg.at online shop or any other online service.

The version of the Terms and Conditions valid at the time of contract conclusion shall be decisive in each case. In the event that these Terms and Conditions refer to natural persons in the male gender only, such references shall equally apply to female and male persons.

Ski School Hirschegg is engaged in the operation of a snow sports school (ski school). Said operation particularly includes services such as training lesson imparting skills and knowledge of skiing, snowboarding or cross country skiing (without any warranty concerning a certain training success) as well as ski-guiding.

2. Order and Contract Conclusion

All offers of Ski School Hirschegg are subject to change and are non-binding.

Contracts for private and group lessons can be concluded on our website via our online shop, via email, submission of a fully completed online form or via phone.

The contract comes into existence only if Ski School Hirschegg has sent an order confirmation to the customer.

At the business premises of Ski School Hirschegg the contractual relationship between Ski School Hirschegg and the respective Customer shall only come into being when the requested service is paid for and the lesson voucher is handed over.
 

3. Prices 

All prices indicated or displayed in the online shop and in the business premises of Ski School Hirschegg are inclusive of VAT at the rate applicable in each case.

Prices do not include the use of lifts.
 

4. Mode of Payment

For payment of ordered services via the online shop, the Customer may use one of the following options:

  • payment by credit card (Visa and Mastercard)
  • Apple Pay
  • Google Pay 

For payment of ordered services in the business premises of Ski School Hirschegg, the Customer may use one of the following options:

  • payment by credit card (Visa and Mastercard)
  • payment by debit card
  • cash payment

Credit card payments in favor of the ski school are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement. The domain where you enter and process your payment is owned and operated by TREKKSOFT.Please send an e-mail to support(at)payyo.ch for all inquiries regarding your credit card payments and chargebacks.
 

5. General terms of participation

If the group is reduced to fewer than 4 participants, Ski School Hirschegg reserve the right to consolidate groups or to reduce the total number of lessons.

Due to flexible organization, actual instructors may change on multiple occasions.

The allocation to the different ability groups for skiing, snowboarding or cross-country skiing lesson shall be made by Ski School Hirschegg. Any changes made by Ski School Hirschegg with regards to the grouping, especially also assignments to less advanced groups, shall in any case be accepted by the Customer, even if they are made after the start of lesson.

The Customer shall be obliged to comply with the instructions given to him or her by Ski School Hirschegg, its legal representatives and agents. If warnings fail to be observed, Ski School Hirschegg shall be entitled to dissolve the respective contract without any delay.
 

6. Liability

Ski School Hirschegg shall not assume any liability for accidents or injuries, which happened during, prior or after the skiing / snowboarding / cross-country skiing lesson. The Customer is recommended to take out a corresponding leisure time insurance (especially an insurance covering rescue and air rescue charges).

The Customer shall be obliged to give Ski School Hirschegg true and complete information about his or her skills and experience in connection with snow sports. Similarly, the Customer shall inform Ski School Hirschegg comprehensively about his or her physical abilities, especially his or her state of health and ailments, if any.

The services rendered by Ski School Hirschegg may, on each level of skill and ability, be connected with high demands concerning materials and the Customer’s physical fitness. For this reason, every Customer is asked to exclusively use properly maintained sports equipment and the usually pre- scribed safety equipment when making use of the ordered services and to assess his or her own performance realistically.

The Customer is asked to note that failure to wear a safety helmet may, in the event of injuries, constitute contributory negligence by the Customer. The Customer is therefore recommended to wear a safety helmet as well as any other safety equipment recommended to be used in connection with the respective service.
 

7. Cancellation

The Customer shall at any time be entitled to withdraw from the concluded contract against payment of the cancellation fees listed hereinafter.

In order to execute this right of withdrawal (cancellation), the Customer must send a rescission notice to the following address by mail or email or contact Ski School Hirschegg by phone:

In case of a withdrawal of the Customer, Ski School Hirschegg shall be entitled to charge the following cancellation fees:

  • cancellation up to 14 days before the start of the booked service: we charge a processing fee of EUR 30.00.
  • cancellation later than 14 days prior to the start or during the ordered services: 100 % of the total price agreed upon (this shall also apply if ordered services are not used)

The deadlines mentioned above shall also be applicable in case of a partial cancellation of ordered services.

In the event of an illness or accident making a participation in the lesson impossible a reimbursement of the paid price shall be possible on submission of a medical certificate issued by a local physician.

If a part of the ordered services has already been used, only the remaining difference will be reimbursed.

Lessons cancelled due to prevailing weather conditions (force majeure) are not made up. Lessons are held in all weather conditions. The lesson ticket is non-transferrable! Unused lesson days are forfeited!
 

8. Warranty

Ski School Hirschegg warrants towards the Customer that the ordered service will comply with the contract, but does not guarantee any training success of the Customer.
 

9. Online Content

The Ski School Hirschegg (hereafter referred to as "author") assumes no liability whatsoever for the topicality, correctness, completeness or quality of the information provided. Liability claims against the author, related to material or ideal damage and which have been caused by the use or improper use of the information provided, or by the use of inaccurate and incomplete information, are expressly ruled out in so far as the author has not acted in a way which is demonstrably either intentionally or grossly negligent.

All offers are subject to change and are non-binding. The author reserves the expressed right to amend, add to or delete parts of pages, or the entire offer, without special notice.
 

10. References and Links

With regards to direct or indirect references to external Internet sites ("links") which are themselves outside the field of responsibility of the author, liability for illegal content will only then be assumed if the author has knowledge of the content of those sites and it is technically feasible and reasonable for the author to prevent usage of said sites.

The author hereby expressly declares that, at the time links were installed on this site, no illegal content was apparent on the targeted sites. This declaration applies to all links placed within its own Internet site, as well as to entries in mailing lists created by the author and to comments in the photo gallery.

Sole liability for illegal, erroneous or incomplete content, and particularly for damages which might by caused by use or non-use of any such information supplied, is borne by the provider of the target site, and not by the provider who included a link to that particular site.
 

11. Copyright and Trademarking

The author makes every effort in all publications to respect copyright on all graphics, audio files, video clips and texts, and to make use of self-created graphics, audio files, video clips and texts, or to avail himself of non-licensed graphics, audio files, video clips and texts.

All those brand names and trademarks cited in the author's Internet platform, some of which are, on occasion, protected by third parties, are subject without restriction to applicable copyright laws and the proprietary rights of the registered owners. The conclusion should not be drawn from their mere naming, that trademarks are not protected by third-party rights.

Copyrights for those objects published and created by the author himself, remain solely with the author. Duplication or use of such graphics, audio documents, video clips and texts in other electronic or print publications, is not permitted, except with the expressed permission of the author.
 

12. Jurisdiction, Place of Fulfilment and Applicable Law

Place of fulfilment for deliveries, services and payments shall be the registered place of business of Ski School Hirschegg. In the event of dispute, the court with jurisdiction at the place of business of Ski School Hirschegg will adjudicate the matter. Austrian law shall apply, contract language is German.
 

13. Legal Validity

If parts of these terms and conditions are or become legally invalid or if there is any gap that needs to be filled, the validity of the remainder of the terms and conditions shall not be affected thereby. Invalid provisions shall be replaced by common consent with such provisions which come as close as possible to the intended result of the invalid provision.
